GiveDirect is an online fundraising platform used by U.S. based charities to process charitable contributions, event registrations, and membership dues online.

If you continue to browse and use this website platform, you agree to comply with and be bound by the following terms and conditions of use, which together with our Privacy and Security Policy govern GiveDirect's relationship with you in relation to this platform. If you disagree with any part of these terms and conditions, we request that you exit our website.

The term 'us' or 'we' refers to GiveDirect. The term 'you' refers to the user or viewer of our platform.

The use of our platform is subject to the following terms of service:

  • Our content is for your general information and use only. It is subject to change without notice.
  • We use cookies to personalize the platform for your use.
  • Our platform contains material which is owned by us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
  • Copying or scraping GiveDirect content is strictly prohibited.

Refund Policy

GiveDirect will refund any transaction within six months of the transaction date, by direct request of the contributor or the receiving charity. After six months, a refund will not be granted. If a contributor initiates a chargeback of a transaction through the credit card company or bank and we feel that the donation or payment was made in good faith, we will dispute the chargeback to demonstrate that the payment was made legitimately.

General Terms And Conditions

Payments
All payments through our platform are made directly to the recipient charity. It is advisable that the user verifies the authenticity of the charity before making a contribution or a payment.

Redirecting to other websites
A payment form may contain links to other websites outside of the platform domain and GiveDirect does not take any responsibility for the authentication or safety of usage of such third-party websites.

Access restrictions
GiveDirect reserves the right to terminate access to the platform upon suspicion of fraud or criminal activity.

Modification of terms and conditions
GiveDirect reserves the right to change the terms and conditions at its own discretion.

Privacy and Security Policy

  • Our privacy and security policy governs data collection and usage and outlines the ways in which we protect your personal information.
  • GiveDirect is committed to protecting your privacy to give you the safest online experience.
  • GiveDirect collects personal information you provide us, like name, address, email address, and phone number. We also collect technical information like browser type, IP address, and referring URL.
  • Your personal information is collected when you submit a donation or a payment. And it is used to provide customer support. GiveDirect does not sell or rent your information to third parties.
  • We will share your personal information with the recipient charity.
  • We use industry standard security measures to protect your data from loss or abuse during transmission across the Internet and on our servers.

Prohibited Organizations, Causes, and Activities

To maintain compliance with applicable laws, payment network requirements, and the requirements of our payment processing partners, GiveDirect does not permit certain organizations, causes, activities, or fundraising campaigns to use the Platform.

Organizations and campaigns may not use the Platform to raise funds for, promote, support, or facilitate:

  • Any unlawful activity or activity that violates applicable federal, state, local, or international laws or regulations;
  • Organizations, individuals, or entities subject to sanctions, embargoes, or restrictions imposed by governmental authorities;
  • Terrorist organizations, terrorist financing activities, violent extremist organizations, or organizations that advocate, encourage, or facilitate violence;
  • Hate groups or organizations that promote discrimination, harassment, or violence against individuals or groups based on protected characteristics;
  • Organizations engaged in money laundering, fraud, deceptive practices, financial crimes, or other illicit activities;
  • Political organizations, political campaigns, political action committees, lobbying organizations, or activities prohibited by applicable payment network or processor rules;
  • Organizations engaged in the sale or promotion of illegal drugs, controlled substances, weapons, ammunition, or other regulated goods prohibited by our payment processing partners;
  • Organizations whose activities present elevated legal, regulatory, reputational, financial, or compliance risks, as determined by GiveDirect or its payment processing partners;
  • Activities that violate the rules, policies, underwriting standards, or prohibited-business requirements of Payrix, Worldpay, card networks, banking partners, or applicable regulators.

GiveDirect reserves the right to deny, suspend, restrict, or terminate access to the Platform for any organization, campaign, fundraiser, or user that is determined to be prohibited, high-risk, non-compliant, or otherwise inconsistent with GiveDirect's legal, compliance, or risk management requirements.

Risk Review and Ongoing Monitoring

As a condition of using the Platform, organizations may be subject to risk-based review, underwriting, monitoring, and compliance assessments conducted by GiveDirect, Payrix, Worldpay, banking partners, payment networks, and other service providers.

Organizations acknowledge and agree that:

  • Approval to use the Platform is subject to successful completion of onboarding, underwriting, compliance, identity verification, and risk review procedures;
  • Additional information or documentation may be requested at any time before, during, or after onboarding;
  • GiveDirect and its payment processing partners may conduct sanctions screening, watchlist screening, fraud prevention reviews, beneficial ownership verification, organizational verification, transaction monitoring, and other compliance reviews;
  • Organizations may be required to provide updated records, governance documents, registration information, tax documentation, financial information, or other materials necessary to satisfy compliance requirements;
  • Fundraising activity, donation activity, transaction volumes, campaign content, beneficiary information, and account activity may be monitored on an ongoing basis to identify fraud, misuse, prohibited activity, or other compliance concerns;
  • Access to payment processing services may be delayed, restricted, suspended, terminated, or subject to reserve requirements if risk concerns are identified or if required information is not provided.

GiveDirect reserves the right to cooperate with law enforcement agencies, regulators, payment processors, banking partners, and other authorized parties in connection with investigations, compliance reviews, or legal obligations.

Information Collected and Verified During Onboarding

To comply with legal, regulatory, banking, and payment processing requirements, GiveDirect and its payment processing partners may collect, verify, and maintain information regarding organizations and their authorized representatives.

Depending on the organization and applicable requirements, this information may include:

  • Legal organization name and any trade or operating names;
  • Physical business address and contact information;
  • Federal Employer Identification Number (EIN) or other tax identification numbers;
  • Proof of tax-exempt status, including IRS determination letters or evidence of 501(c)(3) status, where applicable;
  • Organizational registration documents, formation documents, or other evidence of legal existence;
  • Information regarding directors, officers, trustees, executives, beneficial owners, or authorized representatives;
  • Government-issued identification for authorized representatives and control persons;
  • Banking information for settlement and disbursement purposes;
  • Information regarding fundraising activities, programs, beneficiaries, geographic areas served, and anticipated transaction activity;
  • Financial, operational, compliance, or other supporting documentation reasonably requested during underwriting or ongoing review.

Organizations authorize GiveDirect and its payment processing partners to verify information provided during onboarding and throughout the duration of the relationship using third-party verification services, public records, governmental databases, sanctions lists, watchlists, and other lawful sources.
